My Bubble Tea - may hereon be referred to as 'M.B.T, we or us'.
/ Delivery Guidelines
1.1 M.B.T will make all reasonable efforts to meet a Customers delivery request, however the date and time for any delivery is an estimate only. As such we will not be liable for any loss suffered by the Customer or any third-party due to late delivery. Please note many factors including shipping and packing, and time spent in Customs all contribute to the overall time taken for a delivery to arrive.
1.2 M.B.T will not insure any goods shipped, couriered or otherwise transported to the Customer. We will not be liable to the Customer or any third-party for any loss or damage caused whilst being shipped, couriered or otherwise transported.
1.3 M.B.T may deliver the goods ordered by the Customer in installments unless otherwise agreed to in writing. Delivery of goods to the Customer in installments does not entitle the Customer to cancel their order.
1.4 As we require a signature for all packages delivered, we do not ship to PO boxes or Parcel Lockers. We only ship to valid residential addresses and will not be liable for any lost orders requested for delivery without a recipient signature.
1.5 M.B.T will not liable for any delay at delivery if you choose the wrong delivery area. Parcel rates might vary to default calculation depending on the service and area you choose . M.B.T will also contact with you to pay the difference to allow us to ship the goods to your address.
1.6 Please note these are only estimates—postal delays caused by delivery service providers are outside our control once goods have been passed over for dispatch. There may be some postal delays out of our control, due to COVID-19 issues.
3.1 M.B.T relies upon the Customer to ensure orders are accurate. It is the responsibility of the Customer to ensure they have placed the correct order for any amount of goods they require.
3.2 All orders placed on the M.B.T web site will be payable immediately through either a third-party gateway such as 'PayPal' or our standard Credit Card processing facility. Or in the case of an account customer within fourteen(14) days of the date of the invoice.
3.3 If the Customer does not pay M.B.T for the goods within the time prescribed, the Customer acknowledges and agrees that:
- We may pursue legal representation to recover any amounts owing; and
- The Customer will be liable for M.B.T's legal fees to recover any amounts owing.
3.4 We may discontinue performance if the Customer fails to pay any sum due, or fails to perform under this or any other agreement if after seven(7) days written notice, the failure has not been resolved.
5.1 M.B.T reserves the right to change, correct, amend or supplement the pricing and information contained in this web site without prior notice.
3.2 Prices on consuming foods are GST FREE. But prices on cups, straws, equipment and delivery are exclusive of G.S.T.
6.1 Cancellation of any order will be at the sole discretion of M.B.T
6.2 We are not under any obligation to accept, or reimburse the Customer for, any unused products that are returned.
/ Limited Liability
8.1 M.B.T gives those warranties implied by consumer protection legislation in relation to the product. All other warranties are excluded to the extent permitted by law.
/ Returns and Exchange Policy
2.1 M.B.T will accept, for return or exchange, items that are in new condition, unused, unaltered and free of damage by the customer. For a full refund or exchange please return your purchase within seven (7) days from receipt of the original order. Items cannot be returned or exchanged after seven (7) days from the receipt of original order. All items must be returned in their original packaging.
2.2 Once we receive your item, it will be inspected and we will notify you of the status of your refund.
2.3 The Customer will be responsible for paying for any return shipping costs for the item/s. Shipping costs are non-refundable.
2.4 If packages are returned to us as undeliverable. When the carrier returns an undeliverable package to us, we will not refund the shipping charges cause incorrect address, Refused by Recipient or incorrect information provided. We are unable to re-ship orders that are returned to us as undeliverable.
2.5 To complete your return, we require a receipt or proof of purchase. Please do not send your purchase back to the manufacturer.
2.6 Sale items (if applicable)
Only regular priced items may be refunded, unfortunately sale items cannot be refunded.
2.7 Exchanges (if applicable)
We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at email@example.com
/ Defective Products and Shortages
4.1 If the Customer believes that the product is defective, the Customer must:
- Notify us in writing of the alleged defect within seven(7) days of receipt of the product; and
- If the Customer alleges the product is defective, return the product (at the Customers expense) in its original packaging and inform us of the invoice number and delivery date.
4.2 The Customer will be deemed to have accepted the product unless they notify us otherwise within seven(7) days of receipt of the product.
4.3 If we are not satisfied that the product is defective, we will be under no obligation to replace the product or refund to the Customer any costs. We will not replace any allegedly defective goods or refund the customer the cost of the goods if they were damaged or broken whilst at the risk of the Customer or at the Customers premises.
7.1 Any orders placed by a Customer on our web site will create fully enforceable obligations that will be subject to these terms and conditions.
7.2 M.B.T will not be liable for any performance delays or for non-performance, due to causes beyond our reasonable control.
7.3 The Customer may not assign any rights or obligations hereunder without prior written consent from M.B.T.
7.4 If any term or provision herein is determined to be illegal or unenforceable, the validity or enforceability of the remainder of the terms or provisions herein will remain in effect.
7.5 These terms and conditions constitute the entire agreement between M.B.T and the Customer, and supersede any previous communications, representations or agreements between the parties, whether oral or written; any additional or different terms and conditions will not apply. The purchase of goods will constitute the Customers acceptance of these terms and conditions. The Customer acknowledges and agrees that the supply of all goods by M.B.T will be governed solely by the terms and conditions set out on this page.
7.6 We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only including cooking receipts and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information.
